The EURL DU JEU DE BOULES exploits the brand " Marie Laure Chamorel " and the site www.marielaurechamorel.com (here after the Site)

Article 1: Field of application

The present general selling terms and conditions (CGV) apply in an exclusive way to all the sales of products concluded between the EURL DU JEU DE BOULES (limited liability company unipersonal SIRET: 487 477 838 00030, 23 rue des Blancs Manteaux - 75004, Paris, hereafter "MARIE LAURE CHAMOREL") and non-professional consumers via the Site, hereafter the " Customer(s) ".

These general selling terms conditions are not applicable to professionals buying in the context of their professional activities, wholesalers and distributors.

By "Products" is meant all products marketed via the Site.

The Site delivers to most countries in the world. See list on the attached link.

The fact of placing order on the Site implies the whole adhesion and without reserve of the Customer to these selling terms and conditions, with the exclusion of all other documents such as catalogs, prospectus etc. issued by MARIE LAURE CHAMOREL and which have only an indicative value.

Any contrary condition opposed by the Customer will therefore be, in the absence of express acceptance by MARIE LAURE CHAMOREL, unenforceable against MARIE LAURE CHAMOREL, regardless of when it may have been brought to its attention. The Customer may consult these General Terms and Conditions of Sale simply, freely and at any time by clicking on the link "CGV" at the bottom of each page of the Site. MARIE LAURE CHAMOREL reserves the right to modify these Terms and Conditions. 

Article 2: Order 

2.1 The Customer places his order or pre-order according to the process in force on the Site, namely:
- Step 1: Choice of model, size, color, choice of quantity desired. 
- Step 2: In the "shopping cart" section, you can choose to change quantities, cancel Products, continue shopping, add a promotional code, choose how you want to receive the Product, by delivery, validate the delivery and return conditions, and confirm your wish to order to arrive on the page allowing you to enter your contact information.
- Step 3: Enter your delivery address, your email address and your phone number. You must enter an address where you are likely to receive the delivery and not a post office box.
- Step 4: Choice of delivery method: the price is indicated next to each possible delivery method.

Nevertheless, the delays are indicative and MARIE LAURE CHAMOREL is not responsible for any delays. For more details, please refer to article 7.
The placing of an order obliges to its payment.
An e-mail will be sent to you at the latest the working day following your order or pre-order, to confirm the taking into account of your order.
- Step 5: Choice of payment method: Apple Pay, PayPal, Credit Card (Visa, Mastercard & American Express). You must choose your billing address (which can be the same as the delivery address).
You will have to read the "terms and conditions of sale" and approve them (check box) to proceed to payment.

- Your order is only effective once the payment is made. Before that it is possible to modify or cancel your order. After that, please contact us if you have any question: store@marielaurechamorel.com.

Article 3: Order Confirmation

3.1 Following the completion of your order, you will then receive a confirmation e-mail. If you do not receive it, please contact the customer service by email: store@marielaurechamorel.com

3.2 MARIE LAURE CHAMOREL reserves the right not to confirm an order for any reason whatever, including either a problem of supply of Products, or a problem with the order received. In any case, the Customer will be informed as soon as possible by MARIE LAURE CHAMOREL who will propose a refund.

Article 4: Prices - Taxes – Invoice

The prices are expressed in Euro including all taxes in European Union. The price guaranteed to the Customer is the one displayed on the Site at the time of placing the Product in the basket. This price is firm, final and non-negotiable, it includes preparation costs but not delivery costs.

Delivery costs (standard delivery by post) are offered from 250 euros of purchase for deliveries in metropolitan France (on a single order whose items are deliverable in one go), and from 600 euros of purchase for the deliveries towards the rest of the world.

The prices take into account the VAT applicable on the day of the order. They are therefore indicated including VAT.

Any change in the applicable VAT rate may be reflected in the sale price of the Products in the catalog.

For a delivery outside the European Union, the Customer will have to pay the customs duties, VAT or other taxes due at the time of the importation of the Products in the country of the place of delivery. The related formalities are also the exclusive responsibility of the Customer, unless otherwise specified. The Customer is solely responsible for verifying the possibility of importing the ordered Products under the laws of the country of delivery. 

Marie Laure CHAMOREL takes no responsibility for any custom duties, foreign taxes or other fees that may be imposed during the importation into your local government. 

The total amount indicated at the end of the order summary includes delivery costs and VAT.

The invoice will be sent to the Customer by email.

For deliveries outside of France, an invoice will also be inserted on the package.

For further information, we advise you to contact your local customs office.

Shipping fees and taxes will not be refunded for packages that are refused due to tax and customs duties. 

Article 5: Payment

The accepted means of payment are indicated on the website under the heading "Secure Payments".

The Customer undertakes to pay the total price stipulated on the summary of the order as well as to pay or to have paid, if necessary, directly to the forwarding agent or to the carrier, the customs duties, the VAT or other taxes due at the time of the importation of the Products in the country of the place of delivery.

The Customer shall pay his order in full (no partial payment is accepted) by Apple Pay, PayPal, Credit Card as proposed on the Site.

Before proceeding with the payment, the Customer indicates that he accepts without reserve the present CGV as they exist on the day of his order and which he will have read beforehand. 

The payment of the order constitutes an irrevocable commitment of the Customer which can be called into question only in the cases restrictively envisaged in the present CGV with the articles "Right of cancellation" and "Guarantees".

Article 6: Payment Security

For the security of your payments, MARIE LAURE CHAMOREL uses an online platform to secure payments. This platform respects the strictest standards of certification in order to guarantee the safety of the payments carried out on the site (Certification PCI DSS of level 1; Reports SSAE18/SOC 1 type 1 and 2 and SSAE18/SOC 2 type 1 and 2; in conformity with the European directive DSP2 and with the strong authentication of the customer). 

Article 7: Delivery

7.1 The Products are delivered to the address indicated by the Customer on the form entitled "Information".

7.2 The order will be delivered within the timeframe corresponding to the delivery option chosen by the Customer, subject to the availability of the Product ordered and unless specifically agreed otherwise between the two parties.

The Customer expressly acknowledges that the delivery time:

- May be extended by 5 days for deliveries made outside of metropolitan France and 10 days for deliveries made outside of the European Union,
- May be extended in case of force majeure or problems related to the Post Office or the chosen carrier.

The delivery times are given as an indication and cannot engage the responsibility of MARIE LAURE CHAMOREL. In case of stock shortage or unavailability of the ordered Product, MARIE LAURE CHAMOREL undertakes to inform the Customer as soon as possible and to specify a period of availability or a refund, excluding any damages.

A delay in delivery shall not entitle the Customer to any deduction, penalty, compensation or indemnity.

7.3 If 30 (thirty) days after the order, the Product was not delivered, for any other cause than a case of absolute necessity, the product will be able to be replaced or the sale will be able to be cancelled with the request of one or the other part by letter RAR, with the exclusion of all damages.

Are considered as force majeure discharging MARIE LAURE CHAMOREL from its obligation to deliver: war, riot, fire, strikes, epidemics, accidents, regulation or requirement of public authority, or any other unavoidable event, unforeseeable and beyond the control of MARIE LAURE CHAMOREL. MARIE LAURE CHAMOREL will keep the Customer informed, in a timely manner, of the cases and events listed above.

MARIE LAURE CHAMOREL will reimburse the Customer for all sums paid, at the latest within 14 (fourteen) days of the date on which the contract was terminated.

7.4 Upon delivery, the Customer shall check the content, conformity and condition of the Product(s). In the event of a problem, the Customer must follow the complaint procedure set out in Articles 10 and 11 below. 

Article 8: Transfer of risks

In accordance with Article L216-4 of the French Consumer Code, the risks of loss or damage to the Products are transferred to the consumer at the time when the latter or a third party designated by him (and other than the proposed carrier), takes physical possession of these Products.

If the package received is damaged, or if all or part of the Products in the package are damaged, missing or do not correspond to the order, the Customer (or any third party designated by the Customer) is invited to:

- Take pictures of his/her order, and of the damaged Product(s),
- Refuse to accept the package or the Products concerned and ask the carrier to note the refusal of the package and the anomalies noted. 

The Customer must immediately notify the problem to store@marielaurechamorel.com

If, as a result, the Customer does not take possession of the package, MARIE LAURE CHAMOREL will proceed with the reimbursement of the Customer upon receipt of the return of the package.

Article 9 : Personal data

As the person in charge of processing, the DU JEU DE BOULES Company processes some of your personal data. DU JEU DE BOULES Company commits itself to respecting the French law " Informatique et libertés " (law of January 6th 1978 modified).

Article 10 : Right of withdrawal

10.1. The Customer has a period of 14 (fourteen) calendar days from receipt of his order to notify MARIE LAURE CHAMOREL that he wishes to exercise his right of withdrawal. He is informed that the return of the Products will take place, at his expense, for exchange or refund, in accordance with the article L 212-21-3 of the Code of the Consumption. If this period expires on a Saturday, a Sunday or a holiday or day off, it is extended until the next business day.

In case of purchase of several Products, in a single order and delivered separately, the withdrawal period begins the day the Customer takes physical possession of the last Product.

The cost of returning the Product is payed by the Customer.

The notification of the exercise of the right of return must be made: by e-mail to the address store@marielaurechamorel.com or by registered the attached letter.

MARIE LAURE CHAMOREL will acknowledge receipt of the Customer's request. 

10.2. In the event of sending by the Post office, the Customer will choose a mode of the type "followed" in order to be able to justify the sending in the event of problem of routing.

The Customer undertakes to affix to the parcel or to hand over to the carrier the pro-forma document accessible here that he will have filled in beforehand.

For deliveries outside the European Union, the Customer must take out return insurance against loss and theft with the carrier, corresponding to the value of the product(s) returned.

10.3. After notifying MARIE LAURE CHAMOREL of his/her wish to benefit from the right of withdrawal, the Customer has 14 (fourteen) days to return the Product (including the pouch and the box) by post, courier or carrier, in its original condition and packaging to:

This right of withdrawal is exercised without penalty, with the exception of the return costs and any customs fees, which remain the responsibility of the Customer.

Within a maximum period of 14 (fourteen) days from receipt of the Product at the address of MARIE LAURE CHAMOREL, the Customer will be reimbursed for the amount of products ordered, as well as the amount corresponding to a standard delivery. 

The Product must not have been used/carried, nor to have undergone any deterioration, however small, and to be in a perfect state of cleanliness. The Customer acknowledges that these elements may be verified by MARIE LAURE CHAMOREL who reserves the right to refuse the return if the product does not meet these conditions. In this case, MARIE LAURE CHAMOREL will contact the Customer to explain the reasons for the refusal of his right of withdrawal.

If the products returned by the Customer do not correspond to the Products ordered or do not come from the MARIE LAURE CHAMOREL online store, MARIE LAURE CHAMOREL will not be bound by its obligations described in Article 10.3. above. 

Article 11: Legal guarantees

The guarantees below apply only to the Products of the MARIE LAURE CHAMOREL online store.

MARIE LAURE CHAMOREL asks you to keep your purchase invoice in order to benefit from the guarantees below.

11.1 MARIE LAURE CHAMOREL does not give any warranty for apparent defects, detectable after normal examination of the Product, which may affect the said Product delivered and which have not been reported by the Customer under the conditions stipulated below.

The Customer remains liable for any depreciation of the Products resulting from handling of the Products other than that necessary for the use of the Products.

11.2 Legal warranty of conformity:

The legal warranty of conformity covers the defects of conformity of the Product and the packaging in the following situations:

- Property unfit for the use usually expected of a similar property (for example a manufacturing defect),
- Goods that do not correspond to the description given by the seller,
- Goods that do not have the qualities announced by the seller or agreed with the Customer.

To benefit from the legal guarantee of conformity, the defect of the Product must exist on the day of the acquisition. The Customer is exempted from proving the existence of the defect of conformity of the good during the 24 months following the delivery of the Product. If the defect appears more than 24 months after the purchase, the Customer cannot benefit from the guarantee of conformity except if he can prove that the defect existed at the day of the purchase.

MARIE LAURE CHAMOREL will request the return of the Product in order to carry out an expertise of the Product. The return will have to be carried out in accordance with the provisions of article 10.2 above.

In case of lack of conformity, the Customer chooses between repairing or replacing the Product.

However, MARIE LAURE CHAMOREL may not proceed according to the Customer's choice if this choice entails a cost that is manifestly disproportionate to the other method, taking into consideration the value of the goods or the importance of the defect. In this case, the Customer shall proceed, unless this is impossible, according to the other method.

If repair and replacement of the Product are impossible, the Customer may return the Product and have the price returned, or keep the Product and have part of the price returned. However, the sale cannot be cancelled if the lack of conformity is minor.

The return must be made in accordance with the provisions of Article 10.2 above. 

The Customer has a period of 2 (two) years to return the Product to MARIE LAURE CHAMOREL by enclosing (i) a letter explaining the problem indicating the date of discovery of the non-conformity, (ii) the delivery note and (iii) the invoice.

11.3 In accordance with Article 1641 of the Civil Code, MARIE LAURE CHAMOREL is also bound by the legal guarantee of hidden defects.

In order for the guarantee of hidden defects to come into play, the defect in the Product must meet the following 3 conditions:

- To be hidden, means not apparent at the time of purchase,
- Make the product unfit for its intended use or greatly reduce its use,
- Exist at the time of purchase.

It is up to the Customer to prove the existence of a hidden defect.

The Customer has a period of 2 (two) years to return the Product to MARIE LAURE CHAMOREL by enclosing (i) a letter explaining the problem indicating the date of discovery of the defect, (ii) proof of the existence of the defect (iii) the delivery note and (iv) the invoice.

The return will have to be carried out in accordance with the provisions of the article 10.2 above.

MARIE LAURE CHAMOREL will carry out an expertise of the Product upon receipt.

If MARIE LAURE CHAMOREL considers that the guarantee of hidden defects can be implemented, it will refund the price of the Product appearing on the purchase invoice.

Article 12: After-sales service

If a Product is not covered by the legal guarantees above, MARIE LAURE CHAMOREL proposes a service of repair (within the possibilities of repair) in the case where the conditions below are cumulatively met: 

If the product is truly a MARIE LAURE CHAMOREL product with the logo or oval hallmark for 925 sterling silver items. 

If it is possible to restore the item to its original condition or to improve its appearance,

If the spare parts necessary for the repair are available.

The Customer will have to return the Product at his own expense by post or carrier to the address of the head office and insure the parcel for the market value of the product. MARIE LAURE CHAMOREL declines any responsibility in case of damage, loss or theft during transport.

The Customer undertakes to:

- to join to his sending a letter explaining the problem, indicating his complete coordinates, his email address and his telephone number.
- affix the pro-forma document accessible here that he will have previously filled out on the package or give to the carrier.

Upon receipt of the product to be repaired, MARIE LAURE CHAMOREL will examine the part and will send the Customer an estimate that he/she must accept or refuse by return email.

The return transport of the product once repaired will also be charged to the Customer (cost indicated in the estimate).

MARIE LAURE CHAMOREL reserves the right to modify or adapt these conditions of after-sales service and their impact at its discretion, and at any time.

Article 13: Formation of the contract and proof

The ''validation click'' on ''Pay Now'' constitutes the proof of the formation of the sales contract. This electronic validation between the parties has the same value as a handwritten signature. The click in the box announcing the acceptance of the general conditions of sale also carries the proof of the acceptance without reserve of the present CGV.

The present document exists only in French and English, you declare to understand one of these languages and all the provisions of the present CGV.

It is recommended to print a copy and keep it. 

The computerized registers, kept in the computer systems of MARIE LAURE CHAMOREL in reasonable conditions of security, will be considered as proof of communication, orders and payments between the parties.

The archiving of orders and invoices is made on a reliable and durable medium that can be produced as evidence.

Article 14: Photos

The essential characteristics of MARIE LAURE CHAMOREL's Products are described on the Website alongside one or more photographs which may, despite all the precautions taken by the company MARIE LAURE CHAMOREL, include minimal differences with the item for sale which may result from the distance from which the photographs were taken, the processing of the photographs and the method of transmission and display of the data on the screen. The company MARIE LAURE CHAMOREL could not be responsible for it. 

Article 15: Intellectual property 

MARIE LAURE CHAMOREL is the owner of the intellectual property rights on the Site, in particular tree structure, presentation, design, databases etc. and on the elements appearing on the catalog of the Site - and in particular the texts, the photographs, for which MARIE LAURE CHAMOREL obtained the necessary authorizations of the people concerned, or of which MARIE LAURE CHAMOREL is the author. Consequently, any total or partial reproduction of the Site is strictly forbidden, as well as all the elements contained on the Site.

The MARIE LAURE CHAMOREL brand is also protected by trademark law and it is forbidden to reproduce or use it in any way, including as a domain name.

Any reproduction or use of the elements of the Site would constitute a violation of the regulations on intellectual and industrial property.

The Products themselves, as original creations, are also protected by national and international provisions on copyright.

MARIE LAURE CHAMOREL reserves the right to take legal action against any person who infringes its rights and these general conditions.

Article 16: Security

MARIE LAURE CHAMOREL undertakes to ensure the functioning of the Site in order to allow an optimal use in the conditions defined in the present general conditions.

MARIE LAURE CHAMOREL undertakes to implement technical and organizational measures in accordance with the state of the art to protect your data.

The service may be occasionally suspended due to maintenance interventions necessary for the proper functioning of the Site.

MARIE LAURE CHAMOREL could not be held responsible in the event of dysfunction of the Site because of maintenance, technical problems, the impossibility of accessing the Site and breakdowns of the hosting server or access providers.

Article 17: Final provisions

The present general conditions of sales express the entirety of the obligations of the parties. No other general or particular condition communicated by the Customer will be able to integrate or derogate from the present general conditions.

The fact that MARIE LAURE CHAMOREL does not take advantage at a given time of any of the provisions of these CGV can not be interpreted as a waiver to take advantage later of any of the said conditions.

Article 18: Conflicts

Our customer service is at your disposal by email: store@marielaurechamorel.com and will be able to help you in case of concern.

Nevertheless, and in accordance with article L.133-4 of the French Consumer Code, the Customer is informed of the possibility of resorting free of charge, in case of dispute, to a conventional mediation procedure.

In accordance with Articles L.616-1 and R.616-1 of the Consumer Code, we propose a consumer mediation system. The entity of mediation retained is: CNPM -MEDIATION DE LA CONSOMMATION. In case of dispute, you can file your claim on its website:
